Not that I think it is a bad thing but it looks like President Elect Obama is taking a second look at his proposed tax hikes.

President-elect Barack Obama may consider delaying an election promise - to roll back tax cuts on high-income Americans - as part of his economic recovery strategy, a senior aide and an adviser said on Sunday.

David Axelrod, one of Obama?s closest confidants chosen to be a senior White House adviser, was asked if the tax cut could be ended later than Obama called for during the campaign. ?Considerations will be made,? he said on ?Fox News Sunday.?


I think it is good to change your mind sometimes and this is one of them. Things have changed (although I never thought it was a good idea to increase taxes on anyone) and the economy needs more money in the hands of people willing to spend it. By letting the Bush tax cuts expire they will be doing just the opposite, I think Obama is smart enough to know when to lose a battle to win a war.

As for Gun's and Roses their much anticipated album (Its been 10 years in the making), CHINESE DEMOCRACY DEMOS 1999-2008 2 CD came out over the weekend and Dr Pepper said in March that if the album came out before year end everyone in America would get a free soda. Only borrow money to buy assets that appreciate. Why? If you only borrow money on items that appreciate, the interest you’ll pay can be off-set by the increased value of the item. [05/25/2008, 21:00] Fund of the Week: DJP iPath Dow Jones-AIG Commodity Idx TR ETN
For the second time this month, DJP iPath Dow Jones-AIG Commodity Idx TR ETN had the best one week performance, up 1.60%. It was the only fund up more than 1% and was up more than twice as much as the second best fund, BTTRX American Century Target Mat 2025 My Post , which was up 0.71%.

The rest of the funds in positive territory for the week were bond funds.

DJP also has the best year to date performance of the 90+ funds I track.

Most of the funds were down with SSREX SSgA Tuckerman Active. REIT My Post suffering the biggest loss at -5.09%. All the Real Estate Funds in my portfolios were in the bottom 10 for the wee.

Tomorrow is Independence Day in the United States, a time for friends and family to gather and enjoy the early summer. I’m taking a l-o-n-g weekend, and won’t return until Monday. If I’m lucky, I’ll get a chance to play in the sprinkler.

In the meantime, I thought it would be fun to devote a thread to financial success stories. People send me e-mail all the time to say how they’ve taken control of their personal finances. I love to read these tales, and I know that other people do, too. (We even have a section of the forums devoted to them.)

For example, here’s what one long-time reader wrote a few weeks ago:

I paid off a credit card today!  At times its balance had been as high as $12K, but with the severance pay from my old job, signing bonus from new job, and various other resources, I paid it off completely today.  

The next step is to move the existing balance on my other credit card (about $8K) onto the now-zeroed card at a low balance transfer rate, and then pay down that last balance. It feels really good to have this thing off my back after so long.

[07/01/2008, 13:00] Drama in Real Life: Cancer Scare

My sister-in-law has cancer.

Last week, a biopsy revealed that Stephanie has a cancerous lump on her thyroid. She’ll likely have her thyroid removed, meaning she’ll need to take medication for the rest of her life. (She’s 37 years old.) She’ll also probably need a handful of radioactive iodine chemotherapy treatments.

Prognosis positive
Jeff and Stephanie have both settled down a bit after the initial scare. They’ve heard from many sources, including Steph’s grandmother, that this form (and location) of cancer is easy to eliminate, and has a low chance of spreading or recurring. Steph’s grandmother had her thyroid removed years ago (due to a growth on it), and she is now 77 years old.

Still, this is cancer, which no member of my family takes lightly. My father died from cancer ten days before his fiftieth birthday. Last summer, cancer killed a cousin at age 47. Other family members have died from the disease as well.

A lucky mistake
A situation like this has enormous personal finance implications. Steph’s case is especially interesting because it demonstrates that sometimes the “right choice” isn’t.

Before the birth of their daughter in February 2006, Stephanie obtained a supplemental hospital/short-term disability insurance policy because she knew she would need a C-section. After Emily was born, Steph tried to cancel the policy, but the agent talked her into switching to a cheaper cancer/accident policy instead.

Inspired in part by Get Rich Slowly, Jeff and Steph have been taking control of their personal finances. This past May, when it came time for her office to renew policies, Stephanie asked to have her cancer/accident policy canceled because she wanted to save the $70 recurring monthly expense.

After the cancer diagnosis came through, Jeff and Stephanie were kicking themselves for having canceled the policy — it would have offset some of their upcoming costs. Then Steph remembered that both of her June paycheck stubs still had the deductions listed. She called her agent to see if her policies were still in force. Sure enough, the official cancel date was July 1st, so the agent was able to revoke the cancelation.

“I don’t know if it will pay out enough to compensate for all the premiums we’ve paid in the last two years,” Jeff writes, “but at this point I don’t care. If it helps with the medical bills that are bound to accrue, that’s all that matters.”

A calculated risk
Stephanie’s situation highlights just how difficult it can be to know how much (and what kind of) insurance to carry. It seemed unlikely that she’d need the cancer policy, so she canceled it. From a Big Picture perspective, this was probably the right decision. But in her individual circumstance, it turned out to be the wrong move.

Last fall, in his brief introduction to insurance, Aaron Pinkston wrote that “insurance is the cheapest and most immediate way for a person to displace risks that are too great to assume individually”. That is, insurance allows groups to pool their money to offset unexpected large individual costs.

But how can you decide how much insurance you need? And what types? Later today, I’ll share a guest post about making informed insurance choices.

Meanwhile, friends and family are ready to help Jeff and Stephanie through this crisis. And although they have bigger things to worry about, it gives them a degree of comfort to know they have a little insurance to help with the financial challenges that loom ahead.

[03/19/2008, 15:29] So, what's the problem with Multi Level Marketing scams (er, business models)

PyramidRecently, I wrote a post about the product, Mona Vie, which is sold through a Multi-Level Marketing system.  In case you are not familiar with the product, it is a super juice of some sort with exotic ingredients, such as Acai Berries and Kyrptonite.  I questioned the ability for the juice to cure all the ailments that is claimed by the many distributors out there, and the viability of the business model to actually make money for those same distributors.

The number of comments on that post was pretty incredible.  Many of the comments, not surprisingly, defended the quality of the juice.  The juice was credited with healing, curing or aiding in the following areas:  multiple sclorosis, weight loss, joint pain, high blood pressure, mood swings, something about ORAC values in Leukemia cells, insomnia, headaches, stomachaches, arthritis and gas reduction.  I'm serious.  It does all this.  Read the comments for yourself.  They don't lie.

Of course, there were comments that defended the business model, and in fact the MLM business model in general.  Frankly, being a money blog, this is what interested me.  I could give a damn about the juice.  If it tastes good, doesn't kill people, and can sell, maybe I'll sign up to make some money.  But do I really want to be one of those MLM people out there?

So, here were the arguments in favor of multi-level marketing.

  1. The only way commissions are earned is through the sale of the product.  Building a "downline" can build commissions, but only if the downline sells juice.  The fact that commissions are only tied to the sale of product makes it not a pyramid.
  2. The corporate structure of CEO>VP>Director>Manager>Peon is a pyramid scheme.
  3. It's sales, just like being in sales for a big company.  You get paid commissions for making sales.
  4. MLMs generated over 40 billion in revenue last year, so they can't be scams

I guess so.

So, not a scam?  Sure, why not?  Still something about it bothers me.  Let's say you walk in to your local used car lot, and see a cherry red Mustang.  A salesperson spots you and walks over.   "Sure is purty, ain't she?" he asks.  "Yea," you reply, "how much is it?"  Used car salesperson responds, "well, I'm not supposed to let her go for anything less than $35 grand, but I like your style.  For you?  Let's make it an even $34 grand."  "Wow, really?" you exclaim, "sounds great, let's start up the paperwork."

No scam happened in our little used car skit.  But something just ain't right, you know?

Same feeling I get with all these Mona Vie juice sellers.  If someone tells me that he has felt healthier since drinking a juice that he buys at Whole Foods, I may give it a try.  If that same guy tells me that he feels healthier, and he would be glad to sponsor me to be a distributor in his downline, the red flags go up.

This is the problem with the MLM.  Not that it's a scam.  But your consumers are your salespeople.  There is no greater way to sell a product than third party endorsement.  Third party endorsement happens when someone else compliments you or your product.  If you compliment yourself or your own product, it will always be met with skepticism.  With an MLM, your consumers are your salespeople.  Anytime someone says, "I tried it and it's great," the red flags will always go up.

Although many small businesses begin with only one or two members of staff - the founders - most growing businesses quickly recognise the need to create a larger team. Not only can this spread the workload but a well-selected team can bring in more energy, creativity, drive and knowledge than the founder alone might possess. A small, closely-knit, highly motivated team can be an unstoppable driving force.

The authors of The Beermat Entrepreneur call the members of this core team 'cornerstones'. They suggest that the ideal mix is one entrepreneur providing strong leadership, surrounded by four 'cornerstones' - one for sale, one for finance, one for product development and one for project delivery and customer service. In real terms, most small businesses cannot afford such a big team, and don't really need it to begin with. However, even bringing one other person in to the business can make a huge difference to its success during the first year or so.

In many cases, the original team will be composed of the founder, or founders, and one or two relatives or friends who have been roped in along the way. This works well if everyone is committed to the success of the business and prepared to work hard. As we've seen the early days of a business are defined by long hours and a painfully demanding workload - there is no room for the half-hearted or unenthusiastic. Not only will they not pull their weight, but they will sap everyone else's enthusiasm too.

I've heard it said 'never work with friends or relatives' and it's true that in some cases this leads to disaster. However, a team who like each other - and have a friendship beyond the business - can also be extremely efficient and powerful.

Remember that just because you enjoy spending time with someone socially it doesn't mean you will like working with them. Ask yourself what they would be like to work with. Are they hardworking? Enthusiastic? What do they have to offer your business? Try to find people whose skills compliment yours, who can bring something to the business that fills 'gaps'. For instance, if you are fantastic on the finances but weak on marketing, you need to find someone who can bring something extra to the marketing side of the business.

A recent London Business School survey of CEOs found that they considered the major factor that had contributed to the success of their businesses was 'selecting the right people with good attitudes who are loyal to the company and who want to excel in their careers'.

Defining Roles

Whether you decide to go into business with others as equals or you employ them as part of your original team, it is very important to define roles carefully. Everyone needs to know what is expected of them and where the boundaries of their 'area' lie. In businesses with two or more equal partners a lack of clarity about roles can be a major source of conflict, taking up valuable time that might be better spent focused on other aspects of the business. If you have a management team, you need to give them space to fulfil their roles and feel that their contribution is valued. This doesn't mean handing over control, final decisions will still rest with you (or if they don't you need to be clear about exactly who is the boss - only one person should take this position or squabbling and infighting can result).

Consider the following key roles and divide them between your core team. You should all be clear on who is going to take each role.

Business leader - who takes the final decisions? In other words, the boss.

Sales person - who sells to your customers? Identifies customers and carries out your customer research?

Finance person - who manages the money and the associated administrative work?

Supply management - who locates suppliers, negotiates with them and maintains adequate supply levels.

Core business - who does the core tasks of your business, by which we mean the things that your business is actually about? This might mean making a product, providing a service or something else.

Marketing and PR person - who promotes your business to potential customers and raises the profile of your business?

Some of these roles overlap, so good communication is also of key importance to your business.

Importance of Role Clarification

People do either one of two things in a business - they either add value or they add cost. There are no grey areas.

One of the most important ways to ensure that your core team members are all adding value is to help them clarify their roles.

There are a number of different aspects to role clarification:

Prescribed role - This is what the business uses to set down the individual's overall goals and objectives. It is usually called a 'job description' or something similar and it sets out the person's responsibilities, authority, and key tasks, as well as their position in the business hierarchy.

While this is a useful starting point, it does not take account of personal differences and changes in circumstances such as growth of the business or the need to cover weak performances by others.

Personalised role - the prescribed role is only part of the picture. These are factors internal to the individual which will affect the way he or she performs in the role.

This includes their abilities, skills and strengths, as well as their expectations of the role, their assumptions (about the role, the business, the sector. etc.), their values and ambitions.

Perceived role - the perceptions and expectations of others in the business will have an impact on the individual. For example, they will have their own views on what the priorities of the role should be as well as the boundaries: 'I don't think Sales Managers should...'; 'I expect you to...' These can limit or restrict the way a person performs, but if expectations are high and positive they can raise the person's game, enabling them to perform to their full potential within their current role.

It looks like there is serious talk of between U.S. regulators and Citibank to limit the banks potential losses on toxic assets. Isn't this what the TARP was supposed to do from the beginning? And why Citi and not BOA, JPMorgan, MS etc etc etc. To me it has been one bank after another going down. Once Citi is bailed out the markets will go after the next "Victim".

[02/15/2006, 08:21] 12DailyPro - Stormpay: One man's quest for answers
I've been sitting back, relaxing, and letting all this drama play out. I'm not about to go throwing more money into any programs until things settle down. Now that 12DailyPro has garnered the attention of US law enforcement, it will be interesting to see how the authorities view their business model. Are they going to call it a ponzi and bring charges against those in charge? If so, what happens to all the money? As things stand at the moment, I'm ready to cut my losses until things get a little more stable.

But at least one person is not willing to sit idle while other people figure out ways to spend his 12DailyPro earnings. Jeff Johnson is a man from Utah who apparently lost a significant amount of money from his stormpay account that he had earned with 12DailyPro. Although he will still come out ahead if it turns out that he can't recover the money that stormpay has "charged back" to 12DailyPro, many of the friends and relatives who he referred into 12DP will not. So, feeling some responsibility for their predicament, he has started his own investigation into this whole mess. And he took a news crew with him. I've been following his story for about a week now, and although he's not really getting answers to his burning questions, it's at least good to know that there are people out there fighting for us.

I like this story because it's being reported by an independent third party: ABC4 News. However, although we often count on our news media to be objective and complete in their analysis, they are clearly coming in biased against 12DP. They subscribe to the skeptic viewpoint that something as profitable as 12DP can't be anything more than a scam. So I'm not counting on them to fly back to Salt Lake City waving the 12DP flag, but I am counting on them to at least draw some attention to what is going on. You can read the latest report from them here. Jeff stopped in at Stormpay HQ in Clarksville, TN to talk to the head honchos there and ask them some tough questions. He actually was able to talk to John McConnell (owner) and Steve Girsky (CEO), although they refused to show their faces on camera, citing concerns about death threats they had received. What did we glean from this interview? Three major things:

First of all, there is not enough money in 12DP's frozen stormpay account to be able to refund everyone who made an investment and has not yet been paid - even if you add in the money that stormpay has recovered from 12DP member accounts.

Second, Stormpay denies that they have reached into the bank accounts linked to stormpay in order to recover money earned with 12DP. That contradicts a lot of rumors out there in the forums right now, but I find it hard to believe that stormpay would outright lie about this. ABC4 did some investigating and was unable to find a first-hand source who had their account tampered with. I just looked through the 12DP forum myself and wasn't able to find a person who said that stormpay had removed money from their bank account to fund a chargeback. So I guess it's possible that this was just a rumor with no substance that got out of hand.

Third, Stormpay is being audited by the Tennessee's Better Business Bureau and the Division of Consumer Affairs. The BBB, in turn, has enlisted the help of the FBI. Stormpay has said that they welcome the investigation, apparently confident that they will be cleared of any wrongdoing. The problem is that stormpay has created an accounting nightmare by doing all these chargebacks. 12DP's records about who has been paid and who hasn't are no longer accurate, since a lot of the transactions they had completed have been reversed, without their knowledge. It would have been better for stormpay to simply freeze all the money that was in some way or another connected to 12DP, rather than redistributing it all over the place and making a mess of things.

Jeff Johnson is now on his way to Charlotte, NC to talk to people at 12DailyPro. In the latest ABC4 report, Jeff said that he received a message from 12DP stating that Charis would not speak to him, but that he might be able to talk to one of the attorneys. I imagine that won't answer any questions. Attorneys are good at spitting out a lot of words without ever really saying anything. And since 12DP's business model is shady at best, I imagine they aren't going to be very forthcoming with details.

Okay I admit it? I used to be an active ?chatter? in a local chat room on Yahoo. It was a room where many people from the Dallas area met up to?Chat. Many of us had met outside of the cyber room at local restaurants, clubs and the like.

Yahoo had recently shut down a lot of the member created chat rooms in the wake of all the negativity and sponsor lawsuits. Lets face it?The public opinion of chat rooms was not good. I was a virtual unknown person to most chatters because I stayed away from the ?in person? socials but, that all changed one morning. Here is what happened:

A room regular was talking on ?voice? and venting about his house early one morning and I was listening a few steps away making my breakfast. This is what ?Monte? said, ?I got this letter from some attorney who says he is going to sell my house! How does he think he can do that? He doesn?t own MY house so, how can he sell MY house?? My head spun around so fast that I almost gave myself whiplash. I ran to the computer and grabbed the microphone to speak in the room and here is what was said?

Jim: Monte, what is the name of the law firm that sent you that letter?
Monte: Uhmmm, it says ummm.. Barnett, Burke & Associates.
Jim: Would that be BARRETT Burke?
Monte: Yeah, that?s it.
Jim: Monte, email me your number. I need to talk to you NOW.
(That law firm processes nearly 40% of all foreclosures in the state of Texas)

Within a few minutes I was on the phone with him and I told him that I was a local foreclosure expert and taught classes at Foreclosure Listing Service in Addison. I told him I needed to meet with him and his wife right away because, the letter he got was his notice that his house was in foreclosure and he had less than three weeks left before it would go to the auction. He was shocked and claimed he had no idea (I didn?t know how he could be shocked after missing nine payments). Two hours later I was at his house and explained all about the foreclosure process to him and his wife and what options he may have to save his house.

I remember how bad I felt while explaining the situation because his wife just sat there, staring at me with her eyes wide open, not able to say a word. She had no idea the mortgage was past due at all. She had not seen any letters from the lender or taken any call from them. Monte never told her early on and the situation only got worse as the missed payments added up.

After going over all of the possible solutions, I decided that bankruptcy was likely the best option for them and they agreed. I made a call to Hariett Langston, a friend of mine who is a bankruptcy lawyer in Dallas. Monte and his wife were overwhelmed with the situation and asked if I would go with them when they met with the attorney and I told them I would.

We met with Hariett that same week and everything appeared to be set to stop the foreclosure. All Monte needed to do was pay the bankruptcy filing fee.

A week before the foreclosure sale I went to their house and was a bit surprised to learn that he had not paid the filing fee. I asked him when he was going to file and he just shook his head and said he didn?t know. I remember pausing for a few seconds and it dawned on me why he had not filed. I said, ?Monte? You don?t have the money to file, do you?? In a very humble manner, he looked down at the floor and shook his head. ($500 was the amount he needed to get the bankruptcy filed)

As I drove home I thought to myself that it would be simple if I just wrote a check for the $500 but, I thought that he really needed to pay something so important himself. I got an idea about that time and sent an email to one of the chat room regulars who organized the chat room socials. I recall stating in that email that online chat rooms have such a negative public image and went on to tell her about Monte, his situation and I asked her if she could set up a fund raising get together. It would be our way of proving that normal, everyday people go to chat rooms and this was a chance to show at least one chat room could do something good. I told her that he only needed $500 and all it would take is $5 here, $10 there and a $20 from a few? $500 could be raised.

She arranged to have a Dallas chat fundraiser social for that coming Saturday night. I called Monte and told him about the fundraiser. He asked me to not do it (his pride was the obstacle) but, I told him that we were going to do it anyway and it would be nice if he attended. He later told me he was so choked up that he couldn?t say anything but, he did finally say he would attend.

I expected a handful of people to show up for the fundraiser but, I was wrong. Much to my surprise? At least 50 to 60 regulars from that chat room showed up and contributed. At the end of the night, ordinary people from a Yahoo chat room donated more than $700 to help save someone from losing their house.

The next day I gave the proceeds to Monte & his wife and they quickly paid the attorney the fee to file their bankruptcy and their house?No?Their ?home? was saved.

The story got another interesting twist a few days later. I got a call from a reporter who wrote for a well known local media outlet. They had heard about the fundraiser and thought it was a great community effort story that should be told and asked if I wanted them to write about it.

It took only a few seconds for me to process my answer but, I remember thinking that such publicity would be great for business and my classes would see a boost in attendance. Then I thought about the possibility of other homeowners that would read the story and what would my answer be to them if they contacted me and asked me to do a fundraiser for them as well?

I told the reporter that as wild as the story was, I never expected things to unfold as they did. I told them that I had to pass on their offer because, I had done it to help someone and wouldn?t feel right about profiting off of someone else?s stressful and humbling foreclosure experience. They understood and that was the end of it.

I have to admit . . . Of all the positive experiences I have had in real estate, helping Monte might rank as number one. What stands out in my mind was the fact that so many people pitched in to help save a family from losing their home and they did it for someone most had never met or only knew of by screen name?That?s what made it so great.

This happened in 2005 and two days ago I got a phone call from Monte. He just wanted to give me an update and I was happy to hear they still have their home.

During the call I told him about the reporter. He was surprised I hadn?t told him and more surprised that I turned them down. At the end of the call, Monte told me that three years was long enough and he encouraged me to tell the story of how a bunch of chatters from a Yahoo chat room, came together and did something good.

[11/17/2008, 19:02] My Own Job Layoff Story Plus A Job Loss Tracker

I no longer have a job to worry about (today, I’m self-employed and have other problems…), but allow me to share my own job layoff story with you from way back when.

Scary things are beginning to happen around here as the harsh realities of recession begin to hit closer to home.

At this time, I’m personally encountering more and more people who are hurting because of the effects of the shrinking economy. Here in Silicon Valley, there’s practically nobody I know now who isn’t either laid off, worried about being laid off in the near term, or is in the middle of an active job hunt. Just last week, a dear friend was involuntarily released from his job, while others are debating whether they should take some work time off because “business is slowing down” and they’d rather prepare for what they think is the inevitable.

My Own Job Layoff Story

What I’m seeing here is a much more broad-based recession than the one I remember in 2000. Seven years ago, I was laid off from my position at a Silicon Valley startup because of the dot com bust. The company I worked for imploded painfully after 4 waves of lay offs. I stuck with the company till the bitter end, being one of the core managers and early employees of the company, so I had to participate in the layoff process from both sides of the desk. I had to lay off people in the first 3 waves, and finally, as was expected, I was let go on the last wave as the company itself shut down altogether. It was definitely a sad and stunning process to live through, especially since it was one place I truly enjoyed working 14 hours a day at ;) . But those are the risks and vagaries of startups. Startups and recessions prove to be a lethal combination, unfortunately: they just don’t mix well.

So as the recession hits, we’ve gone from foreclosures, tighter credit, plummeting housing prices, failing banks, crashing stock markets to the dreaded layoffs. The last thing that stands between us and the food line is our cash flow, and once that’s at risk, it’ll be like landing in the final circle of doom in Dante’s Inferno (for some). Speaking of lethal…. More and more are resorting to extreme behavior when their livelihood is threatened. Yet one more tragic indicator of how far this economy has fallen?

Additionally, a link to the Fair Credit Reporting Act is always useful for educating oneself to the rights we have as credit bearers in the United States of America. The great thing about the article I am mentioning is the fact that it includes sample resolution letters, ways to protect credit and identity from theft, and many other tips and bits of advice related to credit reports and scores.
[02/22/2006, 17:07] With 12DailyPro gone, who's left?
Things with 12DailyPro are just getting worse and worse. Charis' latest move is to cancel the convention she's been planning for months now, claiming that because of the media attention she has earned over the past month, the convention "could become a volatile event that could exacerbate current problems and possibly damage our relations with investigators." In plain English, I think that means that she doesn't want herself or her members to wind up in front of a camera, unable to answer questions about her business model. Her attorney claims that they are cooperating with the FBI, and because of that it is inappropriate to comment while they are investigating.

It's no secret that many other surf sites invested in 12DailyPro as a means to finance their own programs. GrandHits and 911Hitz were among them, as they made clear in a message on their member page a few days ago (before they took the sites down). Nate at KnightSurfers, in his admirably forthcoming style, has admitted in the past that he believes in reinvesting in the industry. He undoubtedly lost a pretty sizeable chunk with 12DailyPro, yet he believes that he can continue operating his program with minimal slowdowns. He seems to be one of the more dedicated admins out there, and so I applaud him for that. I hope that he can make it work. I'm currently awaiting payout from a Moneybookers upgrade that I made before they froze his account. He claims that he is in the final stages of getting that money released to him, and at that point he'll be able to level with people like me. It should be any day now...

VivaSurf seems like it is poised to capitalize on 12DailyPro's problems. Vivasurf.us was launched as a way to get around the stormpay problem, but it's evolved into something else now. Vivasurf.us is now a 14% /10 day program, and the new home to a lot of dissatisfied 12DailyPro members. Although Vivasurf had its own problems with Stormpay and has deferred all paymets this month, he seems like he's willing to try to work things out. I'm in for a test drive at the new site, so we'll see how it goes. Robert for sure has a few investments outside the surf industry. His Empowerism page is shown frequently while surfing his sites, as well as one for Kemptech Domains, another site that he owns. He has clearly diversified and is trying to make a real legitimate buck with our upgrades in order to pay us.

Flosurf was a smaller program in which I've been a member for a few months. Flo is very pleasant and forthcoming, and she also seems to be one that we can rely on. Her payouts to date have not been delayed at all. Luna-surf.info is another program that I haven't promoted much, as it's still in the testing phase. Tim, the admin, has also been quite honest about the state of his program and has made it abundantly clear that he has no plans to fold up or reneg on his obligations to the members.

Eprofitsurf and Auto-surf.biz, which were run by the same folks, have now merged. Everything from your auto-surf.biz account should have been combined with Eprofitsurf, so now you just surf the one site, which operates under the old Eprofitsurf terms of 2% for 2 years. They are now running their own payment processor as well: Auto-Surf-Money.com. This is a smart move for them. When people pay in with their own cash, it goes to eprofitsurf. When eprofitsurf pays you, it goes to auto-surf-money. Unless you request a check from them, the money never leaves their hands, it just gets shifted around on paper. That's going to allow them to run on a huge defecit, since many people are going to be content to just see their auto-surf-money account grow on paper without pulling out any cash. At least, that's the way that I see it. It just adds another layer of protection. So my advice to everyone is to keep your auto-surf-money account at a minimum. Keep requesting those withdrawals so that the money stays in your hands.

DadnDave's seems like they are poised to come out on top of the situation as well. They did what I had hoped more sites would do: hit the pause button for a while to get things straightened out and then go back to business as usual. The site basically shut down for the month of February, and is going to come back full strength in March. They're going to add an extra month to everyone's upgrades to compensate for the downtime. Congratulations Dave, that was a very smart move. They are also closed now to new members. He seems to have a good crowd around him and I'm looking forward to more successes there.

It's still going to be touch-and-go for a while as the Stormpay and 12DailyPro situation develops, but at least the sites that I have outlined above seem to be in reasonably good shape. We'll just have to wait and see - March should answer a lot of questions for us.
[05/24/2008, 20:57] Portfolio Update 5/23/08: Driven to Tears
When the best performing portfolio in my experiment is down over 2% in 5 days, I'm almost driven to tears.

This is the first week out of the last 52+ updates when the best performng and worst performing portfolios were the same for Friday's performance, the previous week's performance, performance since May 1st, 2007, and year-to-date.


And no surprise to me, the best performing was the WylieMoney 20 Mostly Managed portfolio and the worst performing portfolio was the S&P 500 as represented by an investment in SPY. Not that the WylieMoney 20 portfolio only beat the Lazy 20 portfolio by .01%.

The Government bailed out Citibank today bu investing $20 Billion and backing a bunch of their less then stellar assets.

"Under the deal, the government will have the right to slash the huge pay packages and bonuses that Citi's executives had long enjoyed, and cap stockholder dividends at only 1 cent per share."

Although this is important I do not think it will turn around the fortunes of the Bank.

You may or may not have heard the term ?ethical will?. But, for those who care about making their values and ethics part of their legacy, it is a tool to consider when planning your estate.

Unlike a ?last will and testament?, which provides for the distribution of a person?s material assets, or a ?living will?, which contains instructions for how you want to be treated medically at the end of your days, an ?ethical will? is designed to let someone preserve and share their values, principles and beliefs for heirs and future generations, though it?s not legally binding.

According to Personal Legacy Advisors? Web site, an ethical will is a letter that transmits the non-material assets that are also of great importance: your values, your story, the lessons life has taught you and the other information that is too valuable to risk being lost. Your ethical will is the tool that enables you to address the question, ?What do I want my loved ones to know??

As a concept, ethical wills are not new. The first written reference to ethical wills occurs in both the Hebrew and Christian Bibles. Examples are Genesis, chapter 49, and The Book of John, chapters 15-18. Over time, they evolved into written documents. While ethical wills were traditionally shared after death, along with the reading of an individual?s last will and testament, today they are often shared during the author?s life.

While exact figures aren?t available for how many people are writing ethical wills, they are on the rise, based on increased Web activity and sales of ethical will resources. They have gained impetus particularly in the wake of tragedies like the September 11 terrorist attacks.

Why create one? People are inclined to write an ethical will when facing a challenging event, or at a turning point in life. Some examples are facing the loss of a loved one, birth of a grandchild, expectant parents, becoming an empty-nester or approaching the end of life. Other reasons to create an ethical will include:

  • Your reflections will confirm what?s important and renew appreciation of your life to date
  • You will create a personal message to those you love, of priceless value in the event of your absence
  • If you do not tell your personal (and family) stories, they may be lost forever
  • Your material assets can be given within a personal context
  • You will mitigate confusion and hurt feelings with a personal explanation of potentially controversial elements of your legal will
  • Your spirit will be expressed on paper, living beyond you in a timeless way
  • Your words will link the past, present and future generations of your family
  • You will enjoy peace of mind knowing the most important things will have been said.

Pros and cons. The pros of an ethical include having an opportunity to influence future generations. Through the process of writing an ethical will, the writer can gain self-knowledge and come to an understanding of what?s most important to him or her. This is valuable information not only for their families but their professional advisers as well. Another pro is that ethical wills are private documents. Unlike a will, which if admitted to probate will become a matter of public record, an ethical will is a private communication and will not be made public unless the author (or recipient) so desires. The con is that an ethical will is not enforceable in a court of law. Those who want to provide specific instructions, such as who is to receive which asset or how assets are to be distributed and under what conditions, would need to put the instruction in a will or trust.

Setting up an ethical will. Ethical wills come in a variety of forms, from a short letter to a lengthy autobiographical statement, from an audio-recorded message to a bound album. There are three basic ways to create an ethical will.

  1. Begin with an outline and list of suggestions. Once you?ve created a rough draft, you can review and personalize it as much as you wish.
  2. Begin with guided writing exercises. For example, start with phrases such as ?From my grandparents, I learned?? or ?I am most grateful for??
  3. Begin with a blank sheet of paper and write down whatever is relevant about your thoughts, experiences and feelings. This is an open-ended approach. Eventually you should be able to create a comfortable structure for your ethical will. For one-on-one help, an organization like the Association of Personal Historians may be of assistance.

Other tips from Personal Legacy Advisors include the following:

  • Start today: If you were not here tomorrow, what is the most important thing you would not want left unsaid? Write it down - now you’ve begun
  • Relax: You are not trying to write for the Pulitzer Prize. The letter is a gift of yourself, written for those you love
  • Ask yourself: What do I want to make sure my loved ones know and have in writing
  • Take it topic by topic: Don’t try to write it all at once
  • Be yourself: You cannot bequeath what you never owned to begin with
  • Be careful, be loving. The reach of this letter is unknowable.

Sharing your will. It?s a good idea to share your ethical will not only with family and friends, but also with your financial adviser and attorney. Knowing what you value and what?s important to you will help them to develop a personalized plan that can help you to leverage your values in the future.

An ethical will speaks to one?s posterity or descendants long after the legal will has been probated and forgotten. Of note, an ethical will is a dynamic document. Just as a will or living trust document needs to be revisited so does an ethical will, because events occur in ones’ life that have an impact on ones’ value systems.
